By accessing or using the Chawkup mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Description of Service

Chawkup is a fitness tracking application that allows users to:

• Log and track workouts
• Monitor fitness progress over time
• Access workout programming and guidance
• Set and track fitness goals
• View performance analytics and insights

User Accounts

Registration

• You must be at least 13 years old to use this Service
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account

Account Security

You agree to notify us immediately of any unauthorized access or use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

Subscriptions and Payments

Subscription Plans

Certain features of the Service may require a paid subscription. Subscription fees are charged through the Apple App Store.

Billing

• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing period
• Subscription management and cancellation are handled through the App Store
• We do not provide refunds for partial subscription periods

Free Trials

If you're on a free trial, you can cancel anytime before the trial ends to avoid being charged. Cancellation instructions are available in your App Store subscription settings.

User Content and Data

Your Content

You retain ownership of all workout data, logs, and content you create in the Service. By using the Service, you grant us a license to use, store, and process your content solely to provide and improve the Service.

Data Backup

While we implement backup procedures, you are responsible for maintaining your own backup of important data. We are not liable for any loss of data.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service to transmit viruses or malicious code
• Impersonate another person or entity
• Harass, abuse, or harm other users

Health and Fitness Disclaimer

Chawkup is a fitness tracking tool and does not provide medical advice. Always consult with a qualified healthcare professional before beginning any exercise program.

• We are not responsible for injuries resulting from use of our Service
• Exercise carries inherent risks; proceed at your own risk
• Stop any exercise if you experience pain, dizziness, or discomfort
• The information provided is for general fitness guidance only

Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by Chawkup and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without permission.

Third-Party Services

Our Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of these third parties. Your use of third-party services is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAWKUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

You may terminate your account at any time by contacting us or deleting your account in the app. Upon termination, your right to use the Service will immediately cease.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
